Terms of Service

Welcome to Pitchgram! These Terms of Service ("Terms") govern your access to and use of the Pitchgram mobile application and services (collectively, the "Service") provided by Pitchgram ("we," "us," or "our"), a company based in South Korea. By accessing or using Pitchgram, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.


1. Description of Service: Pitchgram is a platform that enables users to post product pitches and receive feedback from other users. Users can create profiles, share pitch content in text format, and engage with the community through comments and feedback.


2. Account Registration

  • 2.1 Account Creation: To use Pitchgram, you must create an account by providing accurate and complete information, including your name, email address, job title, and location. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • 2.2 Account Security: You agree to the following terms.

    • Provide accurate, current, and complete information during registration

    • Maintain and promptly update your account information

    • Notify us immediately of any unauthorized access or security breach

    • Be responsible for all activities conducted through your account

  • 2.3 Account Termination: You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your account at our discretion if you violate these Terms.


3. User Content

  • 3.1 Your Content: You retain ownership of all content you post on Pitchgram, including pitches, feedback, profile information, and communications ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, distribute, and display your User Content solely for the purpose of operating and improving the Service.

  • 3.2 Content Standards: You agree that your User Content will not do the followings.

    • Violate any applicable laws or regulations

    • Infringe upon intellectual property rights of others

    • Contain harmful, threatening, abusive, harassing, defamatory, or obscene material

    • Contain viruses, malware, or other malicious code

    • Impersonate any person or entity

    • Contain unsolicited advertising, spam, or promotional materials

    • Include confidential information without proper authorization

  • 3.3 Content Monitoring: We reserve the right, but have no obligation, to monitor, review, or remove User Content that violates these Terms or is otherwise objectionable. We do not endorse any User Content and are not responsible for its accuracy or reliability.

  • 3.4 Feedback on Other Users' Content: When providing feedback on other users' pitches, you agree to be constructive and respectful. Harassment, bullying, or malicious conduct is prohibited.


4. Subscription Plans:

  • 4.1 Tiers: Pitchgram offers two subscription tiers.

    • Basic Tier: Basic access to the Service with limited features

    • Prime Tier: Enhanced access with additional features available through monthly subscription

  • 4.2 Subscription Payments: Prime tier subscriptions are billed on a monthly recurring basis. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

  • 4.3 Refunds: All payments are non-refundable except as required by applicable law or as specified in Apple's App Store policies.

  • 4.4 Changes to Pricing: We reserve the right to modify subscription pricing at any time. Price changes will be communicated in advance and will apply to subsequent billing cycles.


5. Intellectual Property Rights

  • 5.1 Pitchgram Property: The Service, including its design, software, logos, and trademarks, is owned by Pitchgram and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

  • 5.2 Third-Party Rights: You acknowledge that User Content may be protected by intellectual property rights. You are responsible for ensuring you have the right to post any User Content and that it does not infringe upon third-party rights.


6. Prohibited Conduct: You agree not to do the following.

  • Use the Service for any illegal purpose

  • Attempt to gain unauthorized access to the Service or other users' accounts

  • Interfere with or disrupt the Service or servers

  • Use automated systems (bots, scrapers) to access the Service

  • Collect or harvest information about other users without consent

  • Create multiple accounts to manipulate feedback or ratings

  • Engage in any activity that could harm Pitchgram's reputation or operations


7. Privacy and Data Protection: Your privacy is important to us. Our collection and use of personal information (name, email, job title, location) is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.


8. Disclaimers

  • 8.1 Service "As Is": THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

  • 8.2 No Guarantee of Results: We do not guarantee the following.

    • The Service will be uninterrupted, secure, or error-free

    • User feedback will be accurate, useful, or reliable

    • Any pitches posted will result in business success

    • The Service will meet your specific requirements

  • 8.3 User Interactions: We are not responsible for the conduct of users or the accuracy of User Content. You use the Service and interact with other users at your own risk.


9. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITCHGRAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100 USD), WHICHEVER IS GREATER.


10. Indemnification: You agree to indemnify, defend, and hold harmless Pitchgram and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to:

  • Your use of the Service

  • Your User Content

  • Your violation of these Terms

  • Your violation of any third-party rights


11. Dispute Resolution

  • 11.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of South Korea, without regard to its conflict of law provisions.

  • 11.2 Dispute Resolution Process: In the event of any dispute arising out of these Terms or the Service, you agree to first attempt to resolve the dispute informally by contacting us. If the dispute cannot be resolved within 30 days, either party may pursue formal legal action.

  • 11.3 Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts located in South Korea for resolution of any disputes.


12. Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app or by email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.


13. Apple App Store Requirements: If you access the Service through the Apple App Store, you acknowledge and agree the following.

  • These Terms are between you and Pitchgram, not Apple

  • Apple has no obligation to provide maintenance or support for the Service

  • Apple is not responsible for addressing any claims related to the Service

  • In the event of third-party claims that the Service infringes intellectual property rights, Pitchgram (not Apple) is responsible

  • Apple is a third-party beneficiary of these Terms and may enforce them


14. Termination: We may suspend or terminate your access to the Service immediately, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.Upon termination:

  • Your right to use the Service will cease immediately

  • We may delete your account and User Content

  • Provisions that should survive termination (including disclaimers, limitations of liability, and dispute resolution) will remain in effect


15. General Provisions

  • 15.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pitchgram regarding the Service.

  • 15.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

  • 15.3 Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

  • 15.4 Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

  • 15.5 No Agency: No agency, partnership, joint venture, or employment relationship is created between you and Pitchgram as a result of these Terms.
